What is Medical Malpractice?

Medical malpractice occurs when a medical provider breaches the standard of care and causes injury to a patient. A breach of the standard of care is when the providers commits a negligent act during the course of treatment. In other words, when the provider does something wrong or fails to do something that should have been done.

It is important to understand that a bad result does not always mean malpractice. Sometimes a physician or other provider can do everything possible for a patient but still end up with a bad result. This is not malpractice.

Common examples of medical malpractice include:

Failure to diagnosis

Misdiagnosis of an illness

Nursing home injuries and elder abuse

Failure to provide timely treatment

Dropping patients during transfers

Wrongful death

Failure to diagnose an illness

Aanesthesia errors

Leaving a medical device implanted after surgery

Medical malpractice can cause serious and devastating injuries. When a disease such as cancer is not diagnosed correctly or it is not diagnosed at all, it can lead to death. If you or a loved one has been harmed by a medical provider's negligence, contact the attorneys at Tronfeld West & Durrett to determine your rights and whether you have a case.
